講題：Reconciling policing mandates and human rights （警察執法與人權之平衡）

大綱：
The impact of human rights as a set of fundamental values and legal norms on policing has been limited. Though respect for human rights finds expression in the UN Code of Conduct for Law Enforcement Officials, and the Statement of Values of policing agencies in many liberal democracies, the primary mission of police remains prevention of crime, law enforcement, protection of property and public order. This traditional mandate has been subtly but significantly transformed by the post-9/11 imperative to extend proactive and preemptive policing.
This talk explores the crucial role of human rights in promoting legitimacy in the domain of counter-terrorism policing, with particular attention to recent legal challenges before he European Court of Human Rights to the laws in the United Kingdom that gave police wide ‘stop and search’ powers to prevent acts of terrorism.
講者簡介：
Simon Bronitt 教授是澳洲警政卓越中心主任，該中心與本所於2009年簽訂了合作備忘錄。Bronitt教授在轉至Griffith大學前，曾任澳洲國立大學法學院教授兼該校軍法研究中心副主任，2006-2009年間擔任該校人文學院歐洲研究中心主任。Bronitt教授專長為比較法、跨領域研究，發表論文主題以反恐法、人權法、臥底警察、監聽法、國際刑法為主，曾受受澳洲研究基金會委託從事「反恐法研究」（2005-2008），並編著「戰爭與恐怖主義」一書（2008）。
