The impact of human rights as a set of fundamental values and legal norms on policing has been limited. Though respect for human rights finds expression in the UN Code of Conduct for Law Enforcement Officials, and the Statement of Values of policing agencies in many liberal democracies, the primary mission of police remains prevention of crime, law enforcement, protection of property and public order. This traditional mandate has been subtly but significantly transformed by the post-9/11 imperative to extend proactive and preemptive policing.
This talk explores the crucial role of human rights in promoting legitimacy in the domain of counter-terrorism policing, with particular attention to recent legal challenges before he European Court of Human Rights to the laws in the United Kingdom that gave police wide ‘stop and search’ powers to prevent acts of terrorism.
